StandardC, Inc. (“Company,” “we,” “our,” or “us”) is committed to protecting your privacy.  This Privacy Policy explains how your personal information is collected, used, and disclosed by Company.  “You” or “your” means, individually and collectively, any individual person who accesses our Service (as defined below) on your own behalf or on behalf of a Client (as defined below) and Client.

This Privacy Policy applies to our websites, online presence, and platform (that may be used to access services, as set forth in the Clearinghouse Membership Agreement and related agreements) (collectively, our “Service”).  By accessing or using our Service, whether on your own behalf or on behalf of another, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Clearinghouse Membership Agreement and Clearinghouse Rules.

1.  WHAT INFORMATION DO WE COLLECT AND FOR WHAT PURPOSE?

The categories of information we collect can include:

  • Information you provide to us directly.  We may collect personal information, such as your name, phone number, location, social security number, and email address, when you access or use our Service or otherwise communicate with us.  We may also collect any communications between you and Company and any other information you provide to Company. To help the government fight the funding of terrorism and money laundering activities, we obtain, verify and record information about beneficial owners, including you, Clients, and other permitted users of Services. This means that when you access or use our Services, we may ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see other identifying documents, such as a driver’s license. If for any reason, you are unable to provide the information necessary to verify your identity, you are not permitted to access or use the Services.

  • Information we receive from third-party.  We may receive personal information about you from third parties, including, but not limited to, business partners, financial service providers, identity verification services, and publicly available sources. We may combine that with information we collect through our Service.  The data we receive from these third-party sites is subject to third-party’s policies. 

  • Alternative Delivery. You may submit information to us via other methods, including: (i) in response to marketing or other communications, (ii) through social media or online forums, (iii) through participation in an offer, program or promotion, (iv) in connection with an actual or potential business relationship with us, or (v) by giving us your business card or contact details at trade shows or other events.

  • Usage and device information collected automatically through tracking technologies. We, and our third-party partners, may use various technologies that automatically record certain technical information from your browser or device when you visit our website, read our e-mails, access or use our Service, or otherwise engage with us. This information is typically collected through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, “Tracking Technologies”).

  • We, and our third-party partners, use these Tracking Technologies to automatically collect usage and device information, such as:

    • Your IP address, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, a unique ID that allows us to uniquely identify your browser, mobile device, or your account, and other such information.

    • We also collect information about the way you use or access our Service, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, how frequently you access the Services, whether you open e-mails or click the links contained in e-mails, whether you access the Services from multiple devices and other actions you take on the Services.

    • When you access our Service from a mobile device, we may collect unique identification numbers associated with your device or our mobile application (including, for example, a UDID, Unique ID for Advertisers (“IDFA”), Google AdID, or Windows Advertising ID), mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number and, depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g., latitude and/or longitude) or similar information regarding the location of your mobile device, or we may be able to approximate a device’s location by analyzing other information, like an IP address.

Do Not Track Signals. We are unable to respond to Do Not Track signals set by your browser at this time. If you would prefer not to accept cookies, most browsers will allow you to (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies. Depending on your mobile device and operating system, you may not be able to delete or block all cookies, and you may not be able to block non-cookie technologies, and these browser settings that block cookies may have no effect on such techniques. You may also set your e-mail options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our e-mail and performed certain functions with it. Deleting cookies does not delete Local Storage Objects (LSOs) such as Flash objects and HTML5.  You can learn more about Flash objects—including how to manage privacy and storage settings for Flash cookies—on Adobe’s website.  If you choose to delete Flash objects from our sites, then you may not be able to access and use all or part of the sites or benefit from the information and services offered.

2.  HOW WE USE YOUR INFORMATION

We use the information we collect for purposes described in this Privacy Policy or as otherwise disclosed to you on our Service or in connection with our Service. For example, we use your information to:

  • Prevent, investigate or provide notice of fraud or unlawful or criminal activity, and enforce and carry out contracts and agreements between Company and you;

  • Facilitate any transaction requested by you;

  • Create and process an account for you and deliver the Service to you;

  • Facilitate the access to and/or use of a financial product offered by a third-party financial institution (“Partner Financial Institutions”) to you through the Service;

  • Facilitate transactions between you and approved third parties;

  • Send you transactional information, including confirmations, invoices, technical notices, product and services information, updates, security alerts, support and administrative messages, and information about your transactions using the Service;

  • Send transactional information, including confirmations, invoices, technical notices, product and services information, updates, security alerts, support and administrative messages, and information about you to other users of the Service or Partner Financial Institutions;

  • Communicate with you, such as to respond to your comments and questions, provide customer service or feedback, or respond to employment opportunities for which you’ve applied, or for any other purposes in connection with the Service;

  • Conduct research and analytics to understand our visitors and customers, and tailor our product offerings;

  • Facilitate contests, promotions, and rewards and provide you with news about products and services offered by us and our selected partners;

  • Provide you with advertisements based on your interests and order history; Operate, maintain, test, enhance, update, monitor, diagnose, fix and improve our Service; and

  • Comply with legal obligations.

We also use the information we collect to operate, maintain, and provide to you or the entity on whose behalf you are acting (the “Client”) the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages and push notifications.  We may also send you Service-related emails or messages (e.g., account verification, updates to features of the Service, technical and security notices).

3.  SHARING OF YOUR INFORMATION

We may share your personal information in the instances described below. 

Remember, our Service allows you to connect and interact with others. Your information, including your name, and other personal information, may be made available to other members or users of the Service when you create an account or profile to access Services and interact with others using or accessing the Service.

Your information (including and for the avoidance of doubt, information pertaining to Client and its authorized agents and beneficial owners and any other individual person) may be recorded on a secure non-public blockchain. The secure non-public blockchain is a distributed ledger that immutably records encrypted information across a secure network. The encrypted data on the blockchain may be made available to Partner Financial Institutions, Company, and any governmental body or agency, as well as agents thereof (including any auditors retained by such parties to review transaction records maintained on the blockchain). Forensic analysis of the blockchain may lead to deanonymization and the unintentional revelation of information about you. Because blockchains are immutable records, we cannot erase, modify or alter information from such networks or the blockchain. You acknowledge and agree that you are unable to request deletion of any data on the blockchain.

We may share your information, including Client information and information about the owner(s) or controlling members or executives of the Client, with:

  • Other users of the Service.  Certain classes of information you provide us may be provided to third-party users of the Service, including financial institutions, in compliance with applicable law;

  • We share your information with third parties, including financial institutions, with whom you communicate with using the Service or with whom you may seek to transact with or obtain financial services from, in accordance with applicable law; 

  • Partner Financial Institutions and their agents and representatives;

  • Third parties at your request;

  • Other companies owned or controlled by Company and other companies owned by or under common ownership as Company, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns.  These companies may use your personal information in the same way as we can under this Privacy Policy;

  • Third parties with whom we partner to provide any services for you;

  • With third parties who may have products or services you use;

  • Third-party vendors and other service providers that perform services on our behalf, as needed to carry out their work for us;

  • The public when you provide feedback on our Service;

  • Other parties in connection with a Company transaction, such as a merger, sale of company assets or shares, reorganization, financing, change of control, or acquisition of all or a portion of our business by another company or third party, or in the event of a bankruptcy or related or similar proceedings;

  • Third parties as required by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce any agreement we may have with you or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of Company, our visitors, or others;

  • Third-party financial institutions in order to establish eligibility for financial products from such institutions for you;

  • Any party necessary for you to maintain access to, or use of, any financial product obtained in connection with the Services, including any third party necessary to effectuate a transaction requested in connection with the Services; and

  • Third-party financial institutions in order for you to access Services.

In addition, we use your information to facilitate the business relationships we have with you, to comply with our legal obligations, and to pursue our legitimate business interests. We also use your information to complete transactions initiated by you.

We may also share information with others in an aggregated or otherwise anonymized form that does not reasonably identify you directly as an individual.

5.  CONTROL OVER YOUR INFORMATION

You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications.  We make every effort to promptly process all unsubscribe requests.  You may not opt-out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices).

If you would like to review, correct, or update information that you have previously provided us, you may do so by contacting us at support@standardc.io.

You (including and for the avoidance of doubt any individual whose data is collected in connection with the Services) understand that your information may be maintained on immutable blockchain and is therefore unable to be modified, deleted, or erased by us. As such, we may not be able to erase your information or restrict the use of your information (on a distributed blockchain).

6.  THIRD-PARTY TRACKING AND ONLINE ADVERTISING

Interest-Based Advertising.  We may participate in interest-based advertising and use third-party advertising companies to serve you targeted advertisements based on your browsing history or other information.  We may share or we may permit third-party services to collect information about your use of our website over time so that they may play or display ads on our website, online platform, or in connection with our Service, on other devices you may use, and on other websites, apps, or services.  Typically, though not always, the information we share is provided through cookies or similar tracking technologies, which recognize the device you are using and collect information, including click stream information, browser type, time and date you visited the site, and other information.  We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.  

Cross-Device Linking.  We, or our third-party partners, may link your various devices so that content you see on one device can result in relevant advertising on another device.  We do this by collecting information about each device you use when you are logged in to our Service.  We may also work with third-party partners who employ tracking technologies or the application of statistical modeling tools to determine if two or more devices are linked to a single user or household.  We may share a common account identifier (such as an email address or user ID) with third-party advertising partners to help recognize you across devices.  We, and our partners, can use this cross-device linkage to serve interest-based advertising and other personalized content to you across your devices, to perform analytics, and to measure the performance of our advertising campaigns.

Your Choices

  • Cookies and Flash cookies.  Most browsers allow you to adjust your browser settings to: (i) notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies.

    Blocking or deleting cookies may negatively impact your experience using the Service, as some features and services on our Service may not work properly.

    Deleting cookies does not delete Local Storage Objects (LSOs) such as Flash objects and HTML5. To manage Flash cookie settings and preferences, you must use the settings manager on Adobe’s website. If you choose to delete Flash objects from our Service, then you may not be able to access and use all or part of the Service or benefit from the information and services offered.

  • Interest-based advertising. To learn about interest-based advertising and how you may be able to opt out of some of this advertising, you may wish to visit the Network Advertising Initiative’s online resources at http://www.networkadvertising.org/choices and/or the DAA’s resources at www.aboutads.info/choices

  • Cross-device linking.  Please note that opting out of receiving interest-based advertising through the NAI’s and DAA’s online resources will only opt-out a user from receiving interest-based ads on that specific browser or device, but the user may still receive interest-based ads on his or her other devices.  You must perform the opt-out on each browser or device you use.

  • Mobile advertising.  You may also be able to limit interest-based advertising through the settings on your mobile device by selecting “limit ad tracking” (iOS) or “opt-out of interest-based ads” (Android).  You may also be able to opt-out of some—but not all—interest-based ads served by mobile ad networks by visiting http://youradchoices.com/appchoices and downloading the mobile AppChoices app.    

  • Some of these opt-outs may not be effective unless your browser is set to accept cookies.  If you delete cookies, change your browser settings, switch browsers or computers, or use another operating system, you will need to opt out again.

Google Analytics and Advertising.  We may use Google Analytics to recognize you and link the devices you use when you visit our site or Service on your browser or mobile device, log in to your account on our Service, or otherwise engage with us.  We may share a unique identifier, like a user ID or hashed email address, with Google to facilitate the Service.  Google Analytics allows us to better understand how our users interact with our Service and to tailor our advertisements and content to you.  For information on how Google Analytics collects and processes data, as well as how you can control information sent to Google, review Google's site “How Google uses data when you use our partners’ sites or apps” located at www.google.com/policies/privacy/partners/.  You can learn about Google Analytics’ currently available opt-outs, including the Google Analytics Browser Ad-On here https://tools.google.com/dlpage/gaoptout/.

7.  HOW WE STORE AND PROTECT YOUR INFORMATION

Data storage and transfer:  Your information collected through our Service may be stored and processed in the United States or any other country in which Company or its parent, subsidiaries, affiliates, or service providers maintain facilities or otherwise stores information.  If you are located in other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. In addition, information collected about you may be stored on the blockchain or using cloud-based services. Information recorded on the blockchain or information stored in the cloud may be maintained by third-party networks in locations in which such third-party networks operate or maintain data storage or processing facilities.

Keeping your information safe:  We care about the security of your information and employ physical, administrative, and technological safeguards designed to preserve the integrity and security of all information collected through our Service.  However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%.  In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

8.  CHILDREN’S PRIVACY

Company does not knowingly collect or solicit any information from anyone under the age of 13 on this Service.  In the event that we learn that we have inadvertently collected personal information from a child under age 13, we will delete that information as quickly as possible.  If you believe that we might have any information from a child under 13, please contact us at support@standardc.io.

If you are a user of the Services and a California resident, California's "Shine the Light" law (California Civil Code §1798.83) permits you to request and obtain from us once a year, free of charge, information regarding our disclosure of your personal information (if any) to third parties for direct marketing purposes. If this law applies to you and you would like to make such a request, please submit your request in writing in compliance with Section 10.

The Service may contain links to and from third-party websites of our business partners, advertisers, and service providers.  If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies.  We strongly recommend that you read their privacy policies and terms and conditions of use to understand how they collect, use, and share information. We are not responsible for the privacy practices or the content on the websites of third-party sites.

11.  CHANGES TO OUR PRIVACY POLICY

We may modify or update this Privacy Policy from time to time to reflect the changes in our business and practices, so you should review this page periodically.  When we change the policy in a material manner, we will let you know and update the ‘last modified’ date at the bottom of this page.  If you object to any changes, you may close your account. Continuing to use our Service after we publish changes to this Privacy Policy means that you are consenting to the changes.
